1. Who we are

TheHumanBehind is a service operated by AIGiner, S.L., with registered address at Gran Via de Carles III, 98 · 08028 Barcelona · España. You can contact us athello@thehumanbehind.com.

2. What this service is, and what it is not

TheHumanBehind is a registry of self-declarations about digital identities created with artificial intelligence (avatars, voice clones, agents and similar). It lets a person put on record, with a tamper-proof date, that an avatar is theirs and that they take responsibility for it. Basic registration (the green Registered seal) is free and is a private record of standing for its owner. It is not published. Identity verification (the gold Verified seal, a paid service that is not open yet) is what makes a record public.

TheHumanBehind is a private initiative. It isnot an official or government registry, it is not affiliated with, endorsed or approved by the European Union or any public authority, andregistering here does not, by itself, constitute or replace compliance with any legal obligation. What the registry gives you is dated, tamper-evident proof of who declared responsibility for an AI identity: a tool that can help you demonstrate transparency, not a certificate of legal compliance.

3. Your account

• You must provide accurate information when creating your account and keep it up to date.
• You are responsible for keeping your access credentials safe and for all activity under your account.
• One account belongs to one person (or one legal entity acting through an authorised representative).

4. Self-declaration under your responsibility

Each record is a responsible declaration made by you. By registering you affirm that the data provided is truthful and that you have the right to declare yourself responsible for the registered avatar. TheHumanBehind seals the date and content of the record with a cryptographic hash, butdoes not verify the truthfulness of self-declarations at the free level. Responsibility for the declared content lies with whoever registers it.

5. Acceptable use

• Do not register identities you have no right or authorisation over.
• Do not impersonate third parties or provide false or misleading data.
• Do not use the service for unlawful purposes or to infringe others' rights.
• Do not attempt to interfere with the integrity or availability of the registry.

We may suspend or unpublish records that breach these terms or applicable law, without prejudice to any further action. How unpublishing works is described in the database policy.

6. What is public: only once verified

A free Registered record is private: only its owner can see it, it is not listed in the public directory, and it is not served by the public API. Registering does not publish anything. A record's data (avatar name, type, scope, where it operates, responsible person's name, registration number and date, and its cryptographic hash) becomes public(consultable by anyone, including through the public API) only once the record is Verified. The responsible person's email address is never published, at any level. By requesting verification you accept the publication of that data.

7. Your number and your date are immutable

The registry number and the registration date of a record are generated at the moment of registration and cannot be altered afterwards, not by you, and not by our administrators. That is what makes the registry useful as evidence of priority. The content hash always follows the record's current content, and every previous version is archived permanently in an append-only ledger, so an edit leaves a trace instead of erasing one. 8. Verification and payments

Identity verification (the gold Verified seal) will be offered as a paid service that is not open yet. The identity check is carried out by an external identity provider (Stripe Identity is the planned provider);TheHumanBehind never stores your identity document. We keep only the result of the check (verified yes/no), its date and a session reference. The exact conditions and price will be shown before you pay.

Before any payment we will show you, on the payment screen itself, the total price including taxes, how long the service lasts, and whether and how it renews. Nothing renews without us telling you first, and you can cancel from your account at any time; cancelling stops future charges and never deletes your record or its registration date.

8.1 Your right to change your mind (consumers)

If you are a consumer resident in the European Union, you have14 calendar days to withdraw from a paid contract, without giving a reason and without penalty (Directive 2011/83/EU and Articles 102 and following of the Spanish consumer act, RDL 1/2007). The period runs from the day the contract is concluded. To exercise it, an unambiguous statement tolegal@thehumanbehind.com is enough; you may use the model withdrawal form, but you do not have to. We refund within14 days of being informed, by the same means you paid.

One exception, and we state it plainly because it is the one that will apply most often: identity verification is a digital service that isperformed at once. If you ask us to start it before the 14 days are up, you will be asked to confirm that request and to acknowledge thatonce the check has been completed you lose the right of withdrawal for that check. Until you complete the identity check, the right stands untouched. If you have not asked for immediate performance, the 14 days run in full.

9. Using the seal

While your record is active you may display its seal and link to your public record page. You must use each seal truthfully: the free level isRegistered and must never be presented as "verified", and no seal may be presented as an official certification, government approval or endorsement by any public authority. 10. Unpublishing and record-keeping

You can ask to unpublish a record at any time. Because the registry's value lies in its historical integrity, unpublishing is a soft removal: the record's page stops showing its data and instead returns a minimal notice that a record existed at that address and was unpublished. Registration numbers are never reused. See the database policy for the full mechanics and the privacy policy for your data protection rights.

11. Intellectual property

TheHumanBehind brand, fingerprint logo, seals, design and software belong toAIGiner, S.L.. The data you provide remains yours; you grant us only what is strictly necessary to publish and operate it in the registry under these terms. See the intellectual property policy.

12. Availability and changes to the service

The service is provided "as is" and evolves over time. We aim for high availability but do not guarantee uninterrupted service. If we make changes that materially affect your records, we will give reasonable notice through the email address on your account.

13. Limitation of liability

To the extent permitted by law, AIGiner, S.L. is not liable for the accuracy of third parties' self-declarations, nor for damages arising from other users' use of the registry. Nothing in these terms limits liability that cannot be limited under applicable law, including consumer rights.

14. Claims and complaints

If you find a record that impersonates you or infringes your rights, you can claim it or report it. The process is described inclaiming a record, or you can write tolegal@thehumanbehind.com. We review every claim and may suspend a record while a dispute is examined.

14.1 Reporting illegal content, and how we answer

TheHumanBehind stores content that you provide, so it is a hosting service under the EU Digital Services Act (Regulation (EU) 2022/2065). What that means in practice:

• Anyone can notify us of content they consider illegal, by writing to legal@thehumanbehind.com. Tell us where it is (the record's address or its THB number), why you believe it is illegal, and how to reach you. You do not need an account to send a notice.
• We confirm receipt without undue delay and tell you what we decided, along with the reasons. If we restrict a record, its owner gets the same: what we did, why, on what basis, and how to contest it.
• What we moderate, and how. We act on records that breach section 5 or the law: impersonation, content someone has no right to declare, and unlawful use. Decisions are made by a person, not by an automated system, and the measures available to us are the ones described here: suspending a record, unpublishing it, or closing an account. We never delete a registration number or a registration date, because doing so would destroy evidence somebody may need, including the person who complained.
• Points of contact. For Member State authorities, the Commission and the Board:legal@thehumanbehind.com (Articles 11 and 12), in Spanish or English. For anyone else, the same address, or the contact page. Both are electronic and monitored by a person.

If you disagree with a decision, reply to it and we will look again. Nothing here takes away your right to go to a court, or to your national Digital Services Coordinator.

15. Governing law

These terms are governed by Spanish and European Union law. Any dispute will be submitted to the courts of Barcelona (Spain), without prejudice to the mandatory consumer protection rules of your place of residence.

We may update these terms. We will publish the current version on this page with its update date and, for material changes, notify registered users in advance.
